Liabilitiy Waver
Effective Date: April 7, 2026
Introduction
This Liability Waiver (“Waiver”) applies to all services provided under the Be Proactive home and
business inventory documentation program, a service of YNOT Imaging LLC (“Company,” “we,” or
“us”). By scheduling a service, allowing access to your property, paying an invoice, or using the final
inventory reports (“Services”), you (“Client”) acknowledge that you have read, understood, and agree to
this Waiver.
1. Nature of the Service
Be Proactive provides photographic and descriptive documentation of visible property items for the
purpose of helping clients create organized asset records. The Company acts solely as a neutral
documentarian of observable items and conditions at the time the service is performed.
2. Assumption of Risk Related to Documentation
The Client understands that inventory documentation involves photographing, describing, and
recording visible items. The Company does not move large or fragile objects, open sealed containers,
or dismantle installations. As a result, certain items may not appear in the final documentation if they
are not visible or accessible during the service.
3. Property Access and Client Cooperation
The Client agrees to provide safe access to the property and to identify any areas or items requiring
special care. The Company is not responsible for items that are concealed, inaccessible, or
intentionally withheld from documentation.
4. Handling of Personal Property
Our technicians take great care while working in a client’s home or business. However, the Company is
not responsible for ordinary wear, accidental contact, or incidental disturbances that may occur while
documenting property unless caused by gross negligence or intentional misconduct.
5. Estimated Values and Product Identification
Any replacement value estimates or product identifications included in the inventory are informational
only. They are based on publicly available pricing information and reasonable assumptions at the time
of preparation. These figures should not be relied upon as professional appraisals or insurance
coverage determinations.
6. Insurance and Claims
The Client acknowledges that Be Proactive documentation services are intended for pre-loss
recordkeeping purposes only. The Company does not adjust insurance claims, negotiate with insurers,
interpret policy language, or advocate on behalf of the Client in any insurance matter.
7. Limitation of Liability
To the fullest extent permitted by law, the Company’s liability for any claim arising from the Services
shall be limited to the total amount paid by the Client for those Services. Under no circumstances shall
the Company be liable for indirect, incidental, special, or consequential damages including loss of
property value, insurance claim outcomes, or lost profits.
8. Indemnification
The Client agrees to indemnify and hold harmless YNOT Imaging LLC, its owners, employees, and
contractors from any claims, damages, or liabilities arising from the Client’s misuse of inventory reports
or reliance on the documentation for purposes beyond its intended use.
9. Governing Law
This Waiver shall be governed by and interpreted under the laws of the State of Florida.
10. Relationship to Other Agreements
This Liability Waiver works together with the Be Proactive Terms of Service and Privacy Policy.
Together these documents represent the complete agreement governing the Services provided by
YNOT Imaging LLC.
11. Severability
If any provision of this Waiver is determined to be unenforceable, the remaining provisions shall remainin full force and effect.
